1. Who We Are
Second Brain Kids ("we," "us," or "our") is an online K-12 educational platform that provides personalized practice questions, AI-powered tutoring, and homework analysis tools. Our platform is operated from the United States and is subject to U.S. law.

2. Eligibility and Account Registration
Age requirement: You must be at least 13 years old to create an account directly. Children under 13 may only use Second Brain Kids with a parent or guardian account. The parent or guardian must create the account and provide verifiable parental consent before a child under 13 uses the platform. See our Privacy Policy for details on our COPPA-compliant consent process.
Account accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
3. Subscriptions and Payments
Plans: Second Brain Kids offers a monthly plan ($9.99/month) and an annual plan ($79/year). Both plans are per-family: the monthly plan covers up to 3 students in the same household; the annual plan covers up to 5 students.
Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) via Stripe. By providing payment information, you authorize us to charge your payment method on each renewal date.
Cancellation: You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.
Refunds: If you believe you were charged in error, contact us within 14 days of the charge at [email protected]. We will review your request and issue a refund at our discretion.
Price changes: We may change subscription prices with at least 30 days' notice via email. Continued use after the effective date constitutes acceptance of the new price.
4. Acceptable Use
You agree not to:

- 2Use the platform for any commercial purpose without our written permission
- 3Attempt to reverse-engineer, scrape, or copy our content, questions, or AI systems
- 4Upload harmful, illegal, or inappropriate content through any feature (including the Homework Analyzer)
- 5Attempt to circumvent subscription restrictions or access controls
- 6Use automated tools, bots, or scripts to interact with the platform
- 7Impersonate another user, educator, or Second Brain Kids staff member
5. AI Features and Limitations
Second Brain Kids uses AI to power features including the AI Homework Analyzer, AI Tutor, and word lookup. You acknowledge that:
- AI-generated content may contain errors and should not be treated as authoritative academic advice
- The Homework Analyzer analyzes images you upload; accuracy depends on image quality and legibility
- AI explanations are intended to help students learn, not to complete assignments for them
- We do not guarantee that AI responses will be appropriate for every age or grade level
6. Intellectual Property
All content on Second Brain Kids — including practice questions, skill descriptions, AI-generated explanations, worksheets, and platform design — is owned by or licensed to Second Brain Kids and is protected by copyright and other intellectual property laws.
You may use the platform for personal, non-commercial educational purposes. You may not reproduce, distribute, or create derivative works from our content without our written permission.
7. Privacy and Children's Data
Your use of Second Brain Kids is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We take children's privacy seriously and comply with the Children's Online Privacy Protection Act (COPPA). We do not sell personal data and do not use children's data for behavioral advertising.
8. Disclaimers
Second Brain Kids is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. We do not guarantee specific educational outcomes.
To the maximum extent permitted by law, Second Brain Kids shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
9. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. We will handle your data in accordance with our Privacy Policy.
10. Governing Law and Disputes
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of Second Brain Kids shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
Class action waiver: You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
